Terms of Service

1. What NyumbaTrace is

NyumbaTrace connects renters with landlords, agents, and caretakers listing rental properties across Kenya. We are a marketplace, not a landlord, letting agent, or party to any tenancy — we don't own, manage, or guarantee any property listed on the platform, and we're not party to any agreement you make with a landlord, agent, or caretaker.

2. Accounts

You can create an account with an email and password, or sign in with Google. You're responsible for keeping your login credentials secure and for anything that happens under your account. Tell us if you believe your account has been accessed without your permission. You must be at least 18 years old to create an account.

3. Browsing access & fees

Some property details — such as exact location and direct contact information — are only visible after a one-time browsing payment or an active browsing subscription. Payments are processed through our payment partner and, once your access is confirmed, are non-refundable — the fee pays for unlocking that information, not for a guaranteed outcome such as securing a viewing or a tenancy.

Prices for browsing access, and for caretaker/agent listing subscriptions, are shown on the platform at the time of purchase and may change from time to time.

4. Listing a property

If you list a property as a caretaker, landlord, or agent, you confirm that you have the right to list it, that the information you provide (price, location, photos, availability) is accurate, and that you'll keep it up to date — including marking a property as no longer available once it's let. We review listings before they go live, but that review doesn't make us a guarantor of a listing's accuracy; you remain responsible for what you publish.

We may remove or unpublish a listing at our discretion, including for inaccurate information, suspected fraud, duplicate listings, or a lapsed subscription.

5. No guarantee of tenancy

NyumbaTrace helps you find and get in touch about a property. We don't guarantee that a property is still available, that a landlord or agent will respond, or that any viewing or tenancy will result from using the platform. Any agreement about rent, deposit, or move-in is strictly between you and the landlord, agent, or caretaker.

6. Acceptable use

You agree not to:

• Post false, misleading, or duplicate property listings
• Use the platform to harass, defraud, or impersonate someone
• Scrape, copy, or resell listing data without permission
• Attempt to bypass browsing-access restrictions or interfere with the platform's security
• Use another person's account or payment details without authorization

7. Third-party services

NyumbaTrace relies on third parties to operate — Google for sign-in, a payment processor for browsing and subscription fees (including M-Pesa payments), and a mapping provider for property location and directions. Your use of those features is also subject to those providers' own terms.

8. Limitation of liability

NyumbaTrace is provided "as is." To the extent permitted by Kenyan law, we're not liable for losses arising from a listing's inaccuracy, a tenancy that doesn't work out, or platform downtime. Nothing here limits liability that cannot be limited under Kenyan law.

9. Changes to these terms

We may update these terms as the platform changes. If we make a material change, we'll update the date at the top of this page. Continuing to use NyumbaTrace after a change means you accept the updated terms.

10. Governing law

These terms are governed by the laws of Kenya, and any dispute is subject to the jurisdiction of Kenyan courts.
